State Representative Gina Johnsen testified before the House Rules Committee in Lansing to support House Bill 4160, which seeks to reinstate Michigan’s “no stricter than federal” rulemaking standard. The bill would require state agencies to align their regulations with federal standards unless they can provide a clear and convincing justification for exceeding those standards. This requirement was first put into law in 2018 but was repealed in March 2023.
House Bill 4160 also allows exceptions for emergency rules related to public health and safety, as well as rules required for special education.
“Michigan cannot afford regulators writing rules that go beyond Washington without proof,” Johnsen said. “This bill restores accountability and ensures agencies must justify tougher standards with facts.”
Johnsen addressed the economic effects of additional regulation, stating: “Every layer of unnecessary red tape hurts small businesses, manufacturers, and families. HB 4160 keeps government in check and makes Michigan more competitive.”
She also discussed the importance of transparency: “We need a system where agencies serve the people with transparency and responsibility. This legislation makes sure of that.”
Tim Langholz from the National Federation of Independent Business and Mike Witkowski from the Michigan Manufacturers Association joined Johnsen during her testimony. Both spoke about the value of having consistent regulations for employers throughout Michigan.
